Andrew and Tristan Tate will remain in federal custody in Miami while they fight a British request to extradite them to the United Kingdom. A U.S. magistrate judge rejected their request for release, saying the brothers had not shown that they posed no flight risk or danger to the community or that special circumstances justified their release.
U.S. Magistrate Lauren Louis issued the ruling Wednesday after the Tates’ attorneys asked for their release while the extradition case moves forward. The process could take months before a full extradition hearing takes place.
Louis said the brothers failed to satisfy three requirements for release. Her ruling stated, “Having failed to meet these three factors, Respondents’ Motion for Release Pending Extradition Proceedings is DENIED.”
As a result, Andrew Tate and Tristan Tate will remain at the Federal Detention Center in Miami. They have been held there since appearing in court two days after their July 18 arrest.
Prosecutors have argued that the brothers could flee because they have access to significant financial resources and have publicly discussed holding multiple passports.
Defense Team Challenges the Decision
The brothers’ lawyers criticized the detention decision and said it has created a difficult legal situation. The attorneys pointed to the ongoing criminal proceedings in Romania, where the Tates must also defend themselves.
In a statement, their legal team said the brothers are being held in the United States because of the British extradition request while Romanian proceedings continue thousands of miles away.
“They are now facing an extraordinary situation in which they are being held thousands of miles from Romania while Romanian proceedings continue, deadlines approach, an additional indictment is said to be imminent and their own Romanian lawyer says he cannot properly prepare,” the lawyers said.
The attorneys also argued that the brothers cannot properly participate in their Romanian case while being held in a U.S. detention center.
“No serious person can pretend that this can be reviewed properly through occasional conversations from a federal detention center in another country,” the statement said.
The legal team said it is considering an appeal of Louis’ decision.
Legal Cases Span Several Countries
The extradition dispute adds another chapter to the brothers’ long-running legal cases involving the United States, Britain and Romania. In the United Kingdom, they face accusations involving rape and sex trafficking.
The Tates deny the criminal allegations. During a Miami hearing last month, they rejected accusations connected to several countries and argued that their outspoken online personas are exaggerated for social media attention.
They also said claims about their wealth are overstated to increase their influence online.
Romanian authorities have previously allowed the brothers to remain free while their Romanian proceedings continue. Their lawyers have argued that Britain’s extradition request should not take priority because the Romanian case was already underway. According to the defense, the brothers have followed court restrictions and have not attempted to flee Romania.
Earlier this month, Romanian prosecutors indicted the brothers on additional charges.

Andrew Tate, 39, and Tristan Tate, 38, are dual U.S.-British citizens and former professional kickboxers. They became widely known through social media posts focused on wealth, relationships, male dominance and misogynistic views.
Andrew Tate has more than 10 million followers on X. He has also been banned from YouTube, TikTok and Instagram over violations of platform rules concerning hate speech.
He operates an online academy that presents lessons aimed at young men interested in money, relationships and personal success. Tristan Tate has also competed as a kickboxer.
The brothers have publicly supported U.S. President Donald Trump.
The Tates will remain in U.S. custody as the British extradition proceedings continue. Their defense can challenge the detention ruling while preparing arguments against extradition.
The case now involves legal proceedings in multiple countries, with the brothers facing British allegations alongside continuing Romanian cases. The timing and outcome of the extradition process will depend on future court decisions.
